It would now pretty much be illegal in Texas.  Our Wise Legislature has pretty much banned aerial photography unless you have the written permission of everybody in the images and landowners of all properties.  Definition of aerial photos?  Apparently anything taken from  more than 6 feet off the ground.  Tall person?  Tough luck,  get on your knees to snap your photos...
